02. Scope of Digital Services

Siyinkosi Web Designs provides local search engine optimization (Local SEO), Google Business Profile (GBP) setup and ongoing management, online reputation and review request automation, WhatsApp customer communication workflows, and SEO-ready web design to businesses across South Africa.

All bespoke projects or recurring retainers are subject to mutual scope confirmation via formal digital invoice, PayFast subscription authorization, or signed project agreement.

03. Payments, Subscriptions & PayFast

Payment for services is processed in South African Rand (ZAR). Recurring packages (including Google Local Starter at R1,997/mo and Local Dominator at R3,997/mo) are billed on a monthly cycle via PayFast, South Africa's secure payment gateway.

• Deposits: A deposit of up to 50% or the first monthly subscription payment is required prior to commencement of custom web design or campaign setup.
• Billing Cycles: Monthly retainers recur automatically until cancelled by providing 30 days written notice to jackie@siyinkosi.co.za.
• Refund Policy: No refunds will be issued once digital work, Google Business Profile optimization, citation submission, or custom web design has been completed and delivered, except at the sole discretion of Siyinkosi Web Designs.

04. Client Responsibilities

Clients are required to provide accurate business details, branding assets, credentials, and verifications in a timely manner. Delays in client feedback, Google verification access, or media delivery may extend campaign and website delivery schedules.

05. Intellectual Property Rights

All custom web code, graphic designs, and structured frameworks remain the intellectual property of Siyinkosi Web Designs until full invoice or setup payment is cleared. Upon full payment, ownership of client-specific website content transfers to the client, excluding third-party software, APIs, open-source modules, or licensed plugins.

06. Search Engine & Third-Party Disclaimers

While Siyinkosi Web Designs employs industry-leading technical SEO, structured data, and local optimization methodologies, search engine rankings (including Google Maps, Google 3-Pack, and Bing) are governed by third-party search engine algorithms.

We do not guarantee specific organic positions or specific lead counts, as these depend on third-party platform algorithms, competitor activity, and local market factors.

07. Limitation of Liability

To the maximum extent permitted by the Consumer Protection Act (CPA) and South African law, Siyinkosi Consultancy Pty Ltd, its director, employees, and contractor networks shall not be liable for any direct, indirect, incidental, or consequential loss or damages resulting from the use of our website, service downtime, or third-party search platform policy changes.

08. Electronic Communications (ECT Act)

In compliance with Section 43 of the Electronic Communications and Transactions Act (ECTA No. 25 of 2002), clients and users acknowledge that electronic communications, digital form submissions, and email agreements carry full legal validity.

09. Governing Law & Jurisdiction

These terms and conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the South African courts.
